Please ensure that you have read and understood Business Qualifications’ terms and conditions, before placing your order. By placing an order with us you will be deemed to have read, understood, and agreed to these Terms and Conditions.

  1. Definitions

Unless otherwise stated in this terms and conditions document, the following definitions and interpretations of the same apply throughout:

“BQ” means Business Qualifications/Business Quals Ltd

“Distance Learning Package” shall mean the course(s) identified, all related Materials and support, where applicable;

“Materials” means the learning materials and books for the BQ course or any part of them;

“Services” means the support and tuition relating to the chosen BQ course, as described on the website;

“Support Period” means one year from the date of the Sale Agreement or otherwise as stated in your course materials;

“Price” means the price of the Materials, Tutor Support Services, Student Registration and Certification Fees, but does not include postage and packing;

Singular words shall include the plural and vice versa, and headings are included for convenience only and shall not affect the construction or interpretation of these terms and conditions

  1. Payments

We agree to sell, and you agree to buy the Distance Learning Package for the Total Cost/Cash Price and on the terms set out in this document.

The Price is payable prior to the delivery of,or provision of access to,the Materials by your chosen method (in full or by instalments), either by credit/debit card or ApplePay.

The price payable includes all materials, full support, Awarding Body registration and certification fees. Should the purchaser not engage with the learning process via their tutor within 2 months from supply or fails to complete their payment plan, then the supply will revert to the provision of learning material only.

Under no circumstances shall we be deemed to have received payment until full payment has been received by us.

We reserve the right to change the amount of the cost of the course at any time. The current price for any given course will be displayed on the website.

Learners who pay for their course by instalments and complete before full payment is received will not be issued with final certification until full payment is made.

hould your monthly payment fail, the card used for your deposit will be charged if we are unable to reinstate your direct debit or if you cancel without BQ’s prior approval.

Learners who choose to pay for their course by Direct Debit must adhere to the monthly payment terms set out.

Customers who choose to cancel Direct Debit payments will automatically have their course suspended and will be required to make alternative arrangements to cover the full outstanding cost as soon as possible. If no contact is madeto re-instate your direct debit payments within 48 hours BQ will attempt to take payment from your original payment method (credit/debit card).

Learners will not be provided with additional time to complete their course to cover any suspended period due to instalment issues.

BQ will add any missed Direct Debit payment that is returned by the bank to the Direct Debit payment due the following month. This will result in a double payment and the customer must make sure that sufficient funds are available to cover this. Where possible, BQ will attempt to make payment from your original payment method (credit/debit card).

Learners will incur additional charges for failed payments, charged at £17.50 per failed payment and £17.50 for any subsequent correspondence via email, letter or phone call.

If your account remains in arrears for more than 30 consecutive days, we reserve the right to pass your details on to an external collection agency who will be instructed to collect the due balance on our behalf. An additional 20% + VAT will be added to the balance outstanding to cover administration and collection fees.

You may be liable to charges under the Late Payment of Commercial Debts (Interest) Act 1998 as follows:

For a debt less than £1000.00, the sum of £40.00 & VAT; for a debt of £1000.00 or more, the sum of £70.00 & VAT in addition to statutory interest of 8% above Barclays Bank base  rate, calculated daily.

Should you raise an indemnity claim against any direct debit payment, we reserve the right to add a further £30 per claim to the balance outstanding to cover administration and collection fees.

  1. Delivery and care of the materials

We will release all the Materials to you in one dispatch usually within 2-5 working days of receiving payment from you.

Materials will be sent by post or courier to the address you have given us.

You will inspect the Materials upon delivery and will inform us immediately if there are any damages or omissions.

You will be deemed to have accepted the Materials if you do not notify us within seven days after delivery.

Risk of damage or loss in the Materials will pass to you upon delivery.

  1. Services

Each course is allocated with an initial twelve-month support period unless detailed differently on an individual course page. During the Support Period, you will be provided with support and tuition as set out on the website or materials.

If requested, we may at our sole discretion, extend the Support Period which may incur an agreed fee.

A copy of student coursework is required for audit purposes. Unless we receive a written request to the contrary, course work submitted to BQ for marking is sent entirely at the student’s own risk and will not be returned. Students are advised to keep copies of all work submitted to BQ.

BQ works with several Awarding Organisations (AOs) and reserves the right to arrange learner certification through alternative AOs other than those advertised should the need arise due to operational requirements.

Awarding Organisations (AOs) may update their course specifications at any time. Whilst BQ will endeavour to give adequate notice to learners should any actions be required on their part, BQ are not obliged to offer any compensation or refunds to learners if such an event occurs.

Your tutor will normally mark your assignment within 10 working days, although around holiday times it may take a little longer. If you submit more than one assignment at once, your tutor is not expected to mark and provide feedback for every assignment submitted, within the initial 10 working days. If you have not received feedback for an assignment after two weeks, please contact the student helpline.

Your tutor will need to retain your assignments for moderation purposes (checking by another person). Tutor support is inclusive of answering queries and marking work;course completion within your tutor support period is mandatory. Work submitted after your support period has ended will not be marked unless an extension is granted.

Students who have exceeded their 12-month support period are liable to pay an extension fee in order to continue studying towards completion. Extension fees are charged at either £50 per month for the remainder of the course, or £195 to extend by a year.

Extensions are granted at our sole discretion. We cannot grant extensions on qualifications nearing expiry.

If you have allowed your support period to lapse, but you then wish to continue to submit work, you may be required to reactivate your course. Such reactivation will be granted at our sole discretion, and may incur a one-off reactivation fee, normally charged at £20 per month, for each month outside of the support period (up to a maximum of £140). This charge is additional to any fee incurred by extending your support period.

Tutor feedback will be provided electronically to your email address. If you require a paper copy of your feedback an administration and postage charge of £10will be incurred on each occasion a copy is to be sent, which must be paid in advance of release.

Learner work and tutor feedback received will be scanned into our system to be digitally-stored in perpetuity, and original documents destroyed. Some AOs may also retain a copy of learner work and tutor feedback for their own records. If you require a paper copy of your work posted to your address, an administration and postage charge of £10will be incurred for each copy to be sent, which must be paid in advance of release.

Postage costs for learner work submitted to BQ must be paid by the learner. In cases where sufficient postage has not been paid and affixed, BQ will recover a £10 administration fee from the learner to cover the cost of retrieving the work. We are unable to mark work where an administration fee is outstanding.

Students who wish to place their course on hold in extenuating circumstances, will have their case reviewed by our management team. There is no guarantee that such requests will be approved. Students accept that if the qualification expires during a period that the course is on hold or following the course being resumed for the remaining tutor period, it will be their sole responsibility. Tutor support placed on hold, cannot exceed a period of three months.

  1. Warranties and limitation of liability

We warrant that the Materials are of satisfactory quality but do not warrant that the Materials will be error free.

We warrant that we will perform any services provided hereunder with reasonable skill and care.

Other than in respect of liability for death or personal injury arising from our negligence, we shall not be liable for: (a) losses that were not foreseeable to both parties when this Agreement was made; (b) losses that were not caused by any breach on our part; or (c) business losses and/or losses to non-consumers.

Our liability for direct losses arising out of our negligence (other than in respect of liability for death or personal injury), breach of contract or any other cause of action arising out of or in connection with this Agreement shall be limited to the total price paid for the Distance Learning Package as quoted.

Other than in respect of liability for death or personal injury arising from our negligence, we shall not be liable for any indirect or consequential loss or damage whatsoever (including without limitation any loss of profits, loss of revenue, loss of opportunity or your liabilities to third parties) which you may suffer arising out of or in connection with this Agreement.

  1. Other terms

No relaxation or indulgence which we may extend to you shall affect our rights under these Terms and Conditions.

If any part of these Terms and Conditions is held to be unenforceable by a Court of Law, the remaining terms and conditions shall continue in force.

All liabilities or obligations arising under these Terms and Conditions shall be enforceable against you after termination of this Agreement.

You must notify us immediately, in writing, of any change in the address specified. Any notices required to be served under these Terms and Conditions will be deemed properly served if sent by way of prepaid post to your last known address.

If your address is in Scotland then the laws of England & Wales will apply to these Terms and Conditions.

Special Offers – BQ have the right to cancel any order that does not comply with special offer terms regardless of discount codes used at checkout.

Our courses are written around legislation as it relates to England. There may be differences between English legislation and legislation in other parts of the world. Questions can be answered based on local laws where appropriate.  Your tutor must be notified of this when a particular question is answered.

BQ works with many Reseller organisations, and you may find their prices are from time to time more or less expensive than BQ’s. This is invariably due to promotions. Following purchase from one of BQ’s Reseller websites, if you find the same product cheaper on BQ, we will arrange for the Reseller to reimburse you with the difference between the BQ price and that charged by the Reseller. This arrangement will only be applied within 14 days of purchase as price promotions change periodically.

  1. Cancellation

Under the Consumer Contracts Regulations 2014 you have a right to cancel this Agreement. Provided the Goods remain unopened and unused the Buyer has the right to cancel the Contract within 14 days of having received the Goods. If you want to cancel, then you must email us at enquiries@businessqualifications.com. Product must be returned within 14 days of your cancellation request date.Failure to return will result in the contract being upheld for the remaining payments terms and/or anyearlier payments made not being eligible for cancellation.

The buyer only has the right to cancel an order within 14 days of having received the goods as long as no services have been accessed.

If you cancel, then you must return the Materials to the address as directed by BQ within 14 days. You must take good care of them until you do so. Upon receipt of returned materials and on condition they have not been damaged or marked in any way, then you will receive a full refund (unless a deposit has been paid, please see section 5).

Course material returned in an un-resalable condition will be subject to an additional re-stocking fee. With regard to course materials belonging to one of BQ’s partner Colleges, any charges will be at their discretion should the returned materials be damaged or marked in any way.

The buyer must pay for any costs associated with the return of goods.

A £35 administration charge will be retained on all occasions to cover BQ’s costs in setting up a course. If you’ve paid in full, the balance less the administration charge of £35 will be refunded provided it is within the 14-day cancellation period.

Any postage and packing charges incurred by delivery of course materials to the buyer are non-refundable.

If you pay via instalments, you can cancel your order within 14 days of placing the order. Any deposit paid is non-refundable. This deposit may be transferred to a different course at our sole discretion.

If we need to collect the Materials from you then we may charge you our reasonable costs for doing so. Should the materials be damaged in any way and not suitable for resale, a minimum charge of £45 will be charged over and above the reasonable costs of collecting the materials.

Unless the parties have agreed otherwise, you will not have the right to cancel by giving notice of cancellation for the supply of computer software if they are unsealed by you or for the supply of online courseware which has been accessed by you. This also applies to the purchase of books. No refund or cancellation can be obtained for any material which is ‘book only’ and/or purchased as a separate transaction.

If you wish to transfer to a different course, we may at our sole discretion agree to such transfer and a fee of £45 will be incurred.

If we agree that you may transfer to a different course, we will apply the fees paid for the Distance Learning Package you wish to discontinue towards the amount payable for the new course PROVIDED THAT we receive payment from you for the balance of fees due in respect of the new course (if more expensive than the discontinued Distance Learning Package). Should the new course be less expensive, no refunds will be made.

From the point of purchase/login details being provided, customers have fourteen days to consider their purchase (the “Cooling Off Period”).After the Cooling Off Period has elapsed, the option to cancel is forfeit and not allowed.

The option to cancel will not be allowed under any circumstance (either within or outside of the cooling off period) if the course has been accessed and work submitted for marking.

  1. Price Match Guarantee

We match everyone’s prices. No-one matches our service or our commitment to learners.

If you find a cheaper price, we’ll match it. If you find a cheaper price after you’ve bought from us, we’ll refund the difference within seven days.

We aim to offer our learners outstanding service, value, and qualification courses at competitive prices.

To maintain our Price Match Guarantee and not be beaten on price, we constantly monitor prices offered by our competitors and adjust our prices accordingly.

If you find a cheaper price, we’ll match it. If you find a cheaper price after you’ve bought from us, we’ll refund the difference within seven days upon receipt of satisfactory evidence, subject to the following:

  1. The competitor’s course must be identical (length, services, qualification status etc)
  2. The competitor’s price must be publicly advertised online and cannot include any membership or personal discounts
  3. We cannot match bulk promotional offers such as ‘buy one get one free’
  4. The competitor must be based in the UK and sell direct to learners (no auction or marketplace retailers)
  5. No other promotional offers or vouchers can be used on top of a price match

We work and engage with all our students and learners to ensure they have a positive experience which culminates in a successful “pass” and award of the appropriate certification.

Learners must fully engage with Business Qualifications’ tutors and support staff and evidence adoption of any advice or guidance given during the course.

Learners must complete and submit all assignments within the 12 months’ tutor support period or have extended the course duration and completed the final assignment(s) during that extension.

  1. Data protection and General Data Protection Regulation (GDPR)

You agree that, in relation to information which we hold on you from time to time, we may:

Use your information to provide the Materials to you and otherwise perform our obligations and enforce our rights under these Terms and Conditions.

Use your information to inform you about our other courses, products or services which may be of interest to you.

Share your information with our group and associated companies, to enable them to inform you about other products or services which may be of interest to you.

You have a legal right to stop us from contacting you or giving your details to others for direct marketing purposes.You can do this by contacting us by mail, email, or phone.

  1. Complaints

From time to time you may feel the need to make a complaint. In the first instance contact student support to register your complaint.This will then be communicated internally, and we will make an initial response within 24 hours during Monday-Friday office hours.

Your complaint will be assessed for validity and a decision made over any action required.

You will be informed of any appropriate outcome or actions within 5 working days.

You will be reimbursed if appropriate with fees returned if the complaint is upheld.

BQ’s decision is final.You may escalate to senior management at any point in the process.

  1. Use of the BQ website

Your use of the Web pages located within www.businessqualifications.com (“Website”) is subject to the terms set out below (“Terms of use”). These Terms apply only to this Website and not to any other website. Your use of any pages on the Website will constitute your agreement to comply with these Terms. We may amend the Terms at any time by posting the amended terms on this site.
